SB 383 Summary

• Requires voter approval through constitutional referendum to amend Article XXVIII of the Oklahoma Constitution and remove restrictions on low-point beer, beer, light beer, mixed beverage coolers, light wine, and wine.

• Abolishes the constitutional exclusion for beer containing not more than 3.2% alcohol by weight and authorizes sale of beer and wine through licensed retail stores in incorporated cities and towns with populations exceeding 200 persons.

• Allows beer and wine to be offered for sale at room temperature or chilled, with beer sales permitted only in original sealed packages for off-premises consumption.

• Permits retail alcoholic beverage sales only in cities and towns with populations over 200 persons and restricts ownership to one retail store license per person or partnership.

• Becomes effective November 1, 2015, pending approval of constitutional amendments by Oklahoma voters through legislative referendum.
