SB 389 Summary

• Amends Oklahoma toll evasion violation statutes by adding definitions for "video toll collection system" and "toll evasion violation" including failure to pay invoices submitted via video toll collection systems.

• Establishes $25.00 monetary penalty per violation on vehicle owners when operators fail to comply with toll collection regulations, based on preponderance of evidence from photo-monitoring systems.

• Requires Oklahoma Turnpike Authority to mail notices of toll evasion violation within 45 days of alleged violation with option for certified mail follow-up, and provides vehicle owners 21 days to contest or file affidavit of nonliability.

• Creates administrative review process where contested violations are reviewed by an examiner within 90 calendar days, with right to appeal to district court within 20 days of final decision.

• Authorizes Oklahoma Tax Commission to refuse vehicle registration renewal if owner fails to pay toll evasion penalties and allows Authority to collect unpaid penalties through registration holds or collection agencies.

• Effective November 1, 2015.
