Department of Public Safety shall develop a pilot program with maximum of 10 businesses starting no later than July 1, 2016, for two years to evaluate use of certified commercial truck driver training instructors as third-party examiners.

Eligible applicants must be certified commercial truck driver training instructors currently employed by businesses engaged in interstate or intrastate commerce licensed in Oklahoma and can administer Class A, B, or C driving skills exams to non-former students.

Department shall adopt a curriculum for third-party testers meeting the same standards as Department commercial driver examiners, and all businesses and instructors must obtain a Commissioner-approved license.

Businesses pay initial fee of $5,000 and annual renewal of $5,000; individual instructors/testers pay initial certification fee of $2,500 and annual fee of $2,500, with fees deposited to Department of Public Safety Restricted Revolving Fund and non-refundable if certification is denied, suspended, or revoked.

Department must conduct annual nationwide criminal history background checks on all third-party testers and applicants, with costs borne by the tester or applicant, and shall promulgate rules based on federal regulations in 49 CFR Section 383.75.
