SB523 Summary

• Makes human smuggling for profit or commercial purpose a felony punishable by at least 1 year imprisonment or $1,000 fine.

• Prohibits state and local governmental agencies from limiting law enforcement authority to enforce federal immigration laws or investigate federal alien registration violations.

• Authorizes law enforcement to arrest individuals subject to immigration removal orders, Department of Homeland Security detainers, or convicted of aggravated felonies, and requires notification to federal authorities for verified unlawfully present aliens.

• Requires employers receiving economic development incentives to register with and participate in the E-Verify program, with noncompliance resulting in repayment of all incentive monies within 30 days.

• Prohibits individuals age 18 and older from beginning day labor employment without completing federal employment authorization attestation and criminalizes knowing acceptance of consular identification or individual taxpayer identification numbers as public identification.
