• Defines "aging prisoner" as any incarcerated person age 60 or older and establishes conditional release as early release from prison prior to sentence completion, subject to conditions set by the Pardon and Parole Board.

• Requires the Department of Corrections to select an evidence-based risk assessment instrument to evaluate public safety risks posed by aging prisoners seeking conditional release.

• Permits aging prisoners who have served either 10 years or one-third of their total sentence (whichever is shorter) to request a conditional release hearing before the Pardon and Parole Board.

• Mandates the Board grant conditional release if it finds by preponderance of evidence that the prisoner can live at liberty without substantial public safety risk, or if release conditions can reduce any risk to non-substantial levels; determination cannot be based solely on the original offense.

• Requires the Department of Corrections to prepare individualized discharge plans within 30 days of approved release, including supervision conditions, medication supplies, social worker assistance, and for mentally ill/disabled prisoners, mental health treatment assessments and confirmed residential placement.
