SB 585 Summary

• Licensed Oklahoma winemakers may sell wine to licensed charitable organizations as private label wine exclusively for that organization's fundraising or events, beginning July 1, 2016.

• Charitable organizations must obtain licenses from the ABLE Commission for both the organization and the private label wine before distributing wine, with distribution limited to Oklahoma only.

• Licensed private label wine may be distributed through on-premise sales at the charitable organization's office or approved events, mail order delivery, or direct mail shipment from the winemaker, but only in original unopened containers.

• Winemakers selling private label wine must obtain a self-distribution license, register products and prices with the state, and report all sales monthly to the ABLE Commission and Oklahoma Tax Commission while paying applicable excise taxes.

• Winemakers exceeding production volume limits must immediately notify ABLE Commission and sell only to licensed wholesale distributors; violation penalties include a $10,000 fine and a three-year ban on private label sales for second or subsequent violations.
