Charitable organizations must post signs on all unmanned donation bins and drop site containers displaying the charity name, state and federal tax identification numbers, and the charity's primary business location address and phone number.

Compliance deadline is 90 days after the effective date or September 1, 2015, whichever occurs first; charities failing to comply may have bins removed by local jurisdictions and face administrative fines.

Municipalities may seize and forfeit non-compliant donation bins or drop site containers after posting a 10-day notice of intent on the container requiring the charity to either comply with sign posting requirements or notify the jurisdiction.

Seized and forfeited property may be sold with proceeds deposited into the jurisdiction's general fund or donated to another compliant charitable organization; the jurisdiction is immune from liability claims by the charity or donors.

Act becomes effective July 1, 2015, with an emergency clause allowing immediate implementation upon passage and approval.
