SB 695 Summary

• Authorizes public entities to collect unpaid solid waste, storm water drainage, and wastewater service accounts through a formal process including notice, hearing, and lien procedures codified as Section 22-112.5 of Title 11.

• Requires the entity clerk to send notice of delinquent accounts by mail to the account holder and property owner at least 30 days before any hearing or action, with postal receipt confirmation; alternative notice by property posting and publication if parties cannot be located.

• Permits the entity clerk to file a notice of lien against property for unpaid service costs and expenses (excluding late charges, penalties, and interest), which becomes coequal with ad valorem tax liens and superior to all other liens, continuing until full payment with 10-day release requirement upon payment.

• Allows service discontinuation upon finding of delinquency with proper notice, and permits property owners and account holders to appeal the delinquency finding within 30 days.

• Enables wastewater service entities to request water service termination from another public entity when wastewater delinquency is found, with 30-day notice requirement; permits service restoration upon delinquency resolution.

• Effective November 1, 2015.
