Sheriffs and peace officers are responsible for transporting individuals to designated mental health facilities for examination, emergency detention, protective custody, and inpatient services.

Municipal law enforcement handles individuals found within city jurisdiction, while county sheriffs handle those found outside municipalities but within the county.

Law enforcement agencies are entitled to reimbursement from the Department of Mental Health and Substance Abuse Services for transportation of minors and adults requiring mental health services.

Law enforcement agencies may contract with third parties to provide transportation services if the third party meets minimum standards determined by the Department, provided those standards do not exceed law enforcement requirements.

The act became effective November 1, 2015.
