SB 769 - Oklahoma Employee Injury Benefit Act

• Reduces annual nonrefundable filing fee for qualified employers from $1,500 to $1,000, payable upon notification to the Insurance Commissioner and annually thereafter.

• Adds requirement that qualified employers satisfy security requirements under Section 204 as a condition for exemption from the Administrative Workers' Compensation Act.

• Restricts rulemaking authority of the Workers' Compensation Commission, courts, and state administrative agencies regarding design, documentation, implementation, administration, or funding of qualified employer benefit plans.

• Creates rebuttable presumption that an injury was caused by alcohol or drug use if employee tests positive within 24 hours of injury; presumption may only be overcome by clear and convincing evidence of no causal relationship.

• Limits civil lawsuits against qualified employers to claims of intentional tort only, defined as willful, deliberate, specific intent to cause injury, with a 2-year statute of limitations.
