Actual amounts paid for medical services in personal injury cases are admissible at trial instead of amounts billed, provided the medical provider submits a signed statement or sworn testimony accepting the paid amount as full payment.

Medicare reimbursement rates in effect when the injury occurred are admissible if no payment has been made and the provider agrees in writing or by sworn testimony to accept the Medicare rate as full payment.

If a medical provider has filed a lien exceeding the amount paid, bills in excess of payment but not exceeding the lien amount remain admissible.

If no payment has been made and no provider acknowledgment or testimony is provided to the opposing party by the final pretrial hearing, the full billed amount is admissible subject to any lien limitations.

The law applies to personal injury cases filed on or after November 1, 2015, and becomes effective on that date.
