SB 790 Summary

• Amends 28 O.S. 2011, Section 153 to modify criminal case cost assessments collected by court clerks in Oklahoma.

• Eliminates the $25.00 assessment to the Oklahoma Court Information System Revolving Fund effective July 1, 2016 (previously collected in all criminal cases).

• Restructures cost assessment categories by offense type with flat fees: speeding violations $77.00, misdemeanor traffic $98.00, general misdemeanor $93.00, felony $103.00, and DUI offenses $433.00 for both misdemeanor and felony convictions.

• Requires additional assessments beyond base fees including $6.00 for Law Library Fund, $10.00 for traffic cases and misdemeanors for prosecution costs, $15.00 for DUI misdemeanors, and $25.00 for felony cases.

• Becomes effective November 1, 2015.
