Wind energy facilities reaching commercial generation on or after December 31, 2016 must submit evidence of financial security by the fifth year of operation, while those reaching commercial generation before that date must submit by the fifteenth year of operation.

Financial security may be in the form of cash, cashier's check, certificate of deposit, bank joint custody receipt, surety bond, collateral bond, parent guaranty, or letter of credit as approved by the Corporation Commission.

Wind energy facility tower bases must maintain a setback distance of at least 1.5 nautical miles from airport runways, public schools in school districts, and hospitals, with setback compliance disputes falling under exclusive jurisdiction of district courts.

Wind energy facility owners must submit notification to the Corporation Commission within six months of initial FAA filing, publish notification in county newspapers within six months, and hold a public meeting within 60 days of publication; construction cannot commence until these requirements are met.

Owners failing to submit required information face administrative penalties not exceeding $1,500 per day; the Corporation Commission is authorized to promulgate rules and set fees to implement the act.
