Increases minimum setback distance for oil and gas wellbores from occupied structures from 125 feet to 500 feet, and from freshwater wells from 50 feet to 300 feet

Requires wells using hydraulic fracturing techniques to be located at least 2,000 feet from any occupied structure or producing freshwater well

Establishes 100-foot minimum setback for surface equipment (storage tanks, compressors, heaters, separators, dehydrators) from occupied structures

Defines "occupied structure" as any building requiring a certificate of occupancy or intended for human occupancy, including homes, schools, and hospitals

Allows surface owners to waive setback requirements in writing, but only for occupied structures or freshwater wells located on their own property
