HB 1113 Summary

• Amends 47 O.S. 2011, Section 11-314 to expand driver duties when approaching stationary authorized emergency vehicles, Department of Transportation maintenance vehicles, Turnpike Authority maintenance vehicles, or licensed Class AA wreckers displaying flashing red or blue lights.

• On multi-lane highways carrying traffic in the same direction, drivers must proceed with due caution and change lanes away from the stationary vehicle if possible and safe, or otherwise reduce speed to a safe level based on road, weather, and traffic conditions.

• On other highways, drivers must proceed with due caution and reduce speed to a safe speed for existing road, weather, and traffic conditions.

• Operators of stationary authorized vehicles remain liable for reckless disregard for the safety of persons and property on the highway.

• Act became effective November 1, 2015.
