Wind energy facility owners must provide written notification at least 6 months before construction begins to the Corporation Commission, County Clerk, governing body of any affected municipality, and through newspaper publication in the local area

Public newspaper notices must include the facility name, owner/developer name and contact information, boundary map, approximate commercial generation date, and list of school districts within the facility boundaries

Facility owners must notify the Corporation Commission of the commercial generation date so the Commission can track when facilities reach their fifteenth year of operation

After 15 years of operation, owners must file evidence of financial security (surety bond, collateral bond, parent guaranty, or letter of credit) covering anticipated decommissioning costs minus salvage value

Failure to file required information with the Commission subjects owners to administrative penalties up to $1,500 per day
