HB 1408 Summary

• Amends Oklahoma law to establish specific exceptions from food establishment licensing requirements, including produce stands with only unprocessed fresh fruits and vegetables, manufacturers and wholesalers of food, and private home kitchens preparing non-potentially hazardous foods for nonprofit bake sales.

• Exempts from licensing requirements nonprofit civic, charitable, or religious organizations using unpaid volunteers for occasional fund-raising events (defined as four times per year or less), as well as day care facilities, nursing facilities, residential care homes, and assisted living centers.

• Permits the State Board of Health to provide fee-exempt licenses for nonprofit organizations operating food establishments on a more frequent basis than occasional fund-raising events, with such licenses remaining in effect until formally revoked by the Department.

• Allows the State Board of Health to establish licenses for limited-duration or seasonal food service establishments with adjusted fees and timeframes specific to the event or season.

• Becomes effective November 1, 2015.
