Corporation Commission shall implement a regulatory system for Class II disposal wells that substantially duplicates the administration, hearing, and penalty assessment process outlined in the Oklahoma Storage Tank Regulation Act.

Class II disposal site operators who violate a disposal well volume cutback plan are liable for administrative penalties of up to three times the penalty established in Section 311 of Title 17 of the Oklahoma Statutes for each day the violation continues.

Penalties are assessed by the Commission after notice and hearing, considering the violation's nature, circumstances, gravity, the violator's culpability, effect on business ability, and any good faith efforts to achieve compliance.

All collected penalties shall be deposited in the Oklahoma Storage Tank Regulation Revolving Fund.

The act takes effect immediately upon passage and approval due to an emergency declaration for preservation of public peace, health, and safety.
