HB 1580 Summary

• Establishes procedures allowing the Commissioner of Public Safety to investigate municipal law enforcement traffic enforcement practices in areas on the outskirts of municipalities along federal-aid primary highways and state highway systems.

• Allows district attorneys, county commissioners, the State Auditor and Inspector, State Attorney General, or state legislators to request investigations if they believe a municipality is generating more than 50% of its operational revenue from traffic citations.

• Specifies that speeding violations of 14 miles per hour or more over the speed limit shall not be counted when determining if a municipality is using traffic enforcement for revenue generation.

• Requires the Commissioner to submit investigation results to the Attorney General, who has 60 days to determine whether enforcement practices violate the revenue-generation threshold before the Commissioner may designate special traffic enforcement authority.

• Becomes effective November 1, 2015.
