HB 2126 Summary

• Oklahoma Water Resources Board cannot take action that would abrogate rights or privileges associated with permits issued by the U.S. Army Corps of Engineers under Section 404 of the Federal Clean Water Act.

• The Oklahoma Water Resources Board, Department of Environmental Quality, and other state agencies are prohibited from promulgating rules that extend the definition of "waters of the state" beyond the definition in Section 1-1-201 of Title 27A of the Oklahoma Statutes.

• Board shall not evaluate interactions with surface waters when conducting hydrologic surveys and investigations for either major or minor groundwater basins or subbasins.

• Board shall not consider interactions with surface waters when determining maximum annual yield for either major or minor groundwater basins or subbasins.

• Act takes effect immediately upon passage and approval as an emergency measure.
