State Department of Health must develop a violation classification system for continuum of care facilities and assisted living centers, with input from the Long-Term Care Facility Advisory Board

Violations are classified into four severity levels: no actual harm with potential for minimal harm, no actual harm with potential for more than minimal harm, actual harm that is not immediate jeopardy, and immediate jeopardy to resident health and safety

Facilities must submit a correction plan within 60 days upon receiving a statement of deficiencies from the Department

Fines cannot be assessed for violations not classified as actual harm or immediate jeopardy unless the facility fails to correct within the approved timeframe; fines for actual harm or immediate jeopardy violations may be assessed immediately
