Residential care homes may challenge statements of deficiency through informal or alternative dispute resolution by submitting a written request to the State Department of Health within 30 calendar days of receiving the deficiency statement

The alternative dispute resolution process requires a 5-member impartial decision-making panel including: two volunteers with residential care home operations experience, one Department employee with survey process experience, one aging/disabled community representative (non-state agency), and one lay member not employed by the Department

Dispute resolution procedures follow existing processes established in Title 63 of Oklahoma Statutes for nursing facility violations
