HB2943 Summary

• Deletes the 10-day waiting period requirement before an authorized person can submit an affidavit to access a safe deposit box following the lessee's death.

• Requires financial institutions to release all contents of the safe deposit box to the affiant upon receipt of a notarized affidavit stating the lessee has died, the affiant is the authorized person, authorization has not been revoked, and no estate proceeding will be commenced.

• Authorizes the affiant to take possession of all safe deposit box contents and grants power to terminate the lease and close the box.

• Provides that financial institutions are discharged from all criminal and civil liability for releasing contents under these provisions.

• Becomes effective November 1, 2016.
