New and expanded landfills accepting nonhazardous industrial solid waste located within seismic impact zones must demonstrate containment structures are designed to resist maximum horizontal acceleration for the site.

Nonhazardous industrial solid waste landfills cannot be located within 5 miles of a known earthquake epicenter exceeding 4.0 on the Richter Scale or number V on the modified Mercalli Scale as recorded by the Oklahoma Geological Survey.

Coal ash from electric utilities and independent power producers disposed of in noncoal mining operations is subject to solid waste permitting requirements under Title 27A of Oklahoma Statutes.

Fly ash, bottom ash, and kiln dust from coal combustion and cement production remain exempt from permitting requirements when constructively reutilized or disposed of in active or inactive coal or noncoal mining operations.

Act becomes effective November 1, 2016.
