HB 3030 Summary

• Amends Oklahoma marriage law to require courts consider eight specific factors when awarding alimony: legitimate need for support, ability to pay, age and health, education and earning capacity, pre-separation lifestyle, length of marriage, income-producing property received, and budget of each party.

• Modifies alimony provisions in 43 O.S. Section 121 to tie alimony awards to the listed statutory factors rather than general reasonableness standard.

• Maintains existing provisions regarding property division, servicemembers' disability compensation (SMC and CRSC) as separate property, and military retirement pay division under federal law.

• Establishes standard language formulas for dividing active duty military retirement pay (50% times fraction of months married divided by total creditable service months) and reserve retirement pay (50% times fraction of reserve points earned during marriage divided by total reserve points).

• Becomes effective November 1, 2016.
