HB 3052 Summary

• Amends 21 O.S. Sections 649 and 650 to expand the definition of assault and battery upon peace officers to include security guards performing security services and private investigators while in performance of duties.

• Simple assault on a peace officer is punishable by up to 6 months in county jail, a fine not exceeding $500, or both.

• Battery or assault and battery on a peace officer is a felony punishable by up to 5 years in Department of Corrections custody, up to 1 year in county jail, a fine not exceeding $500, or both.

• Aggravated assault and battery on a peace officer is a felony punishable by up to life imprisonment, a fine not exceeding $1,000, or both; if it results in maiming, the penalty is 5 years to life imprisonment and a fine not exceeding $5,000.

• Any attempt to reach for or gain control of a firearm is included in the definition of assault and battery upon law officers; act becomes effective November 1, 2016.
