HB 3098 Summary

• Allows legal residents aged 21+ who are not convicted felons to carry firearms unconcealed without a handgun license under the Oklahoma Self-Defense Act and Oklahoma Firearms Act, effective November 1, 2016.

• Permits unconcealed firearm carry in most locations except government buildings, prisons, schools (with exceptions for designated personnel), sports arenas, and pari-mutuel wagering facilities.

• Prohibits municipalities from establishing policies that restrict lawful firearm possession in parking areas and recreational spaces; allows them only to regulate firearm discharge and improper transportation.

• Establishes that persons carrying firearms openly cannot be disarmed by law enforcement without reasonable and articulable suspicion of criminal activity or probable cause that a crime was committed.

• Implements November 1, 2016 effective date for the Act and removes mandatory firearm registration requirements while maintaining Oklahoma State Bureau of Investigation's authority to issue concealed/unconcealed handgun licenses.
