HB 3118 Summary

• Amends 21 O.S. 2011, Section 1720 to expand theft of vehicle crimes to include motor vehicles, aircraft, construction equipment, farm equipment, self-propelled farm equipment, and trailers.

• Establishes felony penalties for stealing, maliciously damaging, buying/receiving/possessing stolen vehicles or equipment, or taking vehicles without authority and stealing parts: imprisonment of 3-20 years in the Department of Corrections, or fine up to $500,000 (equal to three times property value), or both, plus restitution.

• Creates new felony offenses for unauthorized control or use of transportation with intent to permanently deprive owner, fraudulent misrepresentation to obtain transportation, or keeping lost/mistakenly delivered property without notifying true owner, with same penalties of 3-20 years imprisonment or up to $500,000 fine.

• Requires all buyers of used or secondhand motor vehicles, aircraft, construction equipment, farm equipment, self-propelled farm equipment, or trailers to obtain a bill of sale or title of ownership from the seller as proof of purchase.

• Repeals 47 O.S. 2011, Sections 4-102 and 4-103 relating to unauthorized use, receipt, possession or concealment of vehicles or farm equipment; effective November 1, 2016.
