HB 3146 Summary

• Creates the "Impaired Driving Elimination Act" (IDEA) to centralize prosecution of driving under the influence offenses and establish a statewide impaired driver database

• Establishes $15 assessment on municipal DUI ordinance violations and $15 additional assessment on misdemeanor and felony DUI convictions, both remitted to the Oklahoma Impaired Driver Database Revolving Fund

• Preempts municipal prosecution of DUI offenses except in municipal criminal courts of record, requiring second or subsequent DUI offenses in non-record municipal courts to be filed in district court

• Requires law enforcement to complete impaired driver arrest reports and enter them into the statewide database overseen by the Department of Public Safety Commissioner

• Takes effect November 1, 2016
