HB 3147 Summary

• Beginning November 1, 2017, raises the minimum age to purchase tobacco and vapor products from 18 to 19 years old; increases to 20 years old on November 1, 2018; and increases to 21 years old on November 1, 2019.

• Modifies the definition of "proof of age" to reference "the appropriate age pursuant to subsection A of Section 600.3" rather than specifying a fixed age, allowing the definition to adjust with the phased age increases.

• Clarifies that vapor products include noncombustible products with mechanical heating elements or batteries that produce vapor, whether or not they contain nicotine, but excludes products regulated by the FDA.

• Maintains existing penalties for violations including administrative fines up to $300 and license or permit suspension of up to 60 days, with employees subject to driver license suspension for unpaid fines.

• Becomes effective November 1, 2016.
