Unemployment benefits for seasonal workers are payable only during normal seasonal work periods, not during off-seasons when workers have reasonable assurance of returning to work the following season

Employers must apply to the Commission at least 20 days before a seasonal work period begins to receive "seasonal employer" designation; the Commission has 90 days to make a determination

Seasonal employers must notify employees in writing within 7 days of hire about their seasonal worker status and provide written notice of reasonable assurance of rehire by the last day of the season

Workers denied benefits due to reasonable assurance of rehire are entitled to retroactive unemployment benefits if the employer fails to actually rehire them for the next season

Construction industry employers are explicitly excluded from seasonal employer designation; seasonal employment is defined as regularly recurring periods of 26 weeks or less in any 52-week period
