Allows cemeteries to reclaim ownership of unused burial spaces 75 years after the last recorded activity on the space, provided a reasonable search for heirs and beneficiaries has been conducted.

Requires cemeteries to send a certified letter to the last-known address of the record property owner and publish notice of the abandoned burial space in a qualified newspaper for three weeks.

Deems a burial space abandoned if no person proves ownership within one year after publication.

Provides that persons with legitimate claims to spaces already used or sold by the cemetery receive an equal burial space in an equivalent location as a remedy.

Becomes effective November 1, 2016.
