Eliminates the insanity defense for first-degree and second-degree murder charges under Oklahoma law, while preserving the defense for all other criminal offenses

Amends 21 O.S. 2011, Section 152 to exclude mentally ill persons from the class of individuals incapable of committing first or second degree murder

Amends 22 O.S. 2011, Section 1161 to specify that acts committed in a state of insanity can still be punished as public offenses when the charge is first or second degree murder

Effective date set for November 1, 2016
