Counties, municipalities, and public trusts with county or municipal beneficiaries may provide a local bid preference of up to 5% on public construction contracts exceeding $50,000 if the governing body determines economic benefit to the local area

Local bidders must agree to perform the contract at the same price and terms as the lowest nonlocal bidder, and may only receive the preference if they are the second lowest qualified bid

"Local area" is defined as all areas within a 100-mile radius of the municipality or county where the awarding public agency or public trust is located

Entities granting local bid preferences must adopt an established policy demonstrating economic benefit to the local economy, and bid specifications must clearly state the bid is subject to local preference law

Effective date is November 1, 2016
