Hospitals may adopt guidelines governing interactions between organ procurement organizations and hospital staff

Organ procurement organizations are prohibited from using coercion or emotional abuse against patients, families, physicians, or hospital staff during any aspect of the organ donation process

"Emotional abuse" is defined to include demanding, insisting, or pressuring families in ways that fail to exhibit sympathy, compassion, or sensitivity to emotional well-being

The prohibition applies to all stages of organ donation, including testing, screening of potential donors, and organ procurement

Effective date: November 1, 2016
