SB1394 Summary

• Modifies the Rebuilding Oklahoma Access and Driver Safety Fund (ROADS Fund) by making the annual apportionment of $59,700,000 (starting fiscal year 2013) contingent on the State Board of Equalization determining that General Revenue Fund estimates will grow at least 4% year-over-year.

• Adds new subsection I requiring the State Board of Equalization to make this determination at the February meeting required by Oklahoma Constitution Article X, Section 23, beginning with fiscal year 2016.

• Maintains the fund's total annual apportionment cap of $575,000,000 and requires that apportionments to the Rebuilding Oklahoma Access and Driver Safety Fund occur before other allocations from income tax revenues.

• Preserves existing provisions that funds from the ROADS Fund cannot supplant state transportation funding and that the State Board of Equalization must issue annual findings regarding whether fund expenditures enhanced or supplanted Department of Transportation state funding.

• Effective July 1, 2016, with emergency clause declared.
