Oil and Gas Water Recycling and Reuse Act - SB 1414

• Establishes the "Oil and Gas Water Recycling and Reuse Act" and codifies it as Section 155 of Title 52 of the Oklahoma Statutes.

• Defines "fluid oil and gas waste" as waste containing salt, mineralized substances, brine, hydraulic fracturing fluid, flowback water, produced water, or other fluids arising from drilling or production of oil and gas.

• Establishes property ownership rules: when waste is transferred for treatment, the receiving person owns it until transferring it to another for disposal or use; treated products and byproducts become the property of the person receiving them.

• Grants liability protection to persons who treat fluid oil and gas waste and transfer the treated product with contractual understanding it will be used in oil and gas operations, protecting them from tort liability for consequences of subsequent use.

• Preserves liability for personal injury, death, or property damage claims arising from exposure to fluid oil and gas waste or treated products.
