SB 1424 Summary

• Requires criminal history background checks including Oklahoma State Courts Network searches, Child Care Restricted Registry searches, national criminal history records searches, and sex offender registry checks for child care facility owners, employees, volunteers, and residents prior to licensing, employment, or unsupervised access to children.

• Mandates national criminal history records searches based on fingerprints conducted by Oklahoma State Bureau of Investigation and Federal Bureau of Investigation with "Rap Back" notification of subsequent criminal activity, with results delivered through secure electronic transmission.

• Authorizes Office of Juvenile Affairs to directly request national criminal history records searches from Oklahoma State Bureau of Investigation for employees and applicants of secure detention centers, municipal juvenile facilities, community intervention centers, and secure facilities licensed by the Office.

• Prohibits individuals required to register as sex offenders from working with children or residing in child care facilities, with violations punishable by up to 5 years incarceration and $5,000 fine, plus potential license revocation, injunctive proceedings, and administrative penalties up to $10,000.

• Requires all background check information to be maintained confidentially by facilities, with limited release to other child care facilities considering employment of the same individual, and becomes effective November 1, 2016.
