SB1432 Summary

• Amends 47 O.S. 2011, Section 172 to add a new penalty for motor vehicle owners operating in excess of 120,000 pounds gross weight in violation of Section 14-103G, punishable by a fine not exceeding $3,000.00.

• Maintains existing misdemeanor penalties for violations of motor carrier regulations, with general violations punishable by fines not exceeding $1,000.00.

• Establishes that contempt violations subject to Corporation Commission fines shall not exceed $500.00 per day, with collected fines deposited to the Corporation Commission Trucking One-Stop Shop Fund.

• Clarifies enforcement officer authority to inspect vehicles, require submission of bills of lading and shipping documentation, and prohibits plea bargaining by enforcement officers except for the chief legal counsel.

• Becomes effective July 1, 2016, with emergency provisions allowing immediate effect upon passage and approval.
