SB 1468 Summary

• Amends 10A O.S. 2011, Section 1-4-904 to modify termination of parental rights procedures in Oklahoma.

• Establishes exception to the requirement that a child must be adjudicated as deprived prior to or concurrently with termination proceedings when grounds for termination fall under paragraphs 8 (certain criminal convictions) or 12 (parental incarceration) of subsection B.

• Retains all existing legal grounds for termination of parental rights, including voluntary consent, abandonment, failure to correct conditions, criminal convictions, abuse or neglect, foster care placement timelines, and incapacity to parent.

• Specifies that incarceration alone is insufficient grounds for termination but may be considered with other factors affecting the parent-child relationship and child's safety.

• Takes effect November 1, 2016.
