SB1472 Summary

• Amends Oklahoma Pharmacy Act (59 O.S. 2011, Section 353.24) to clarify unlawful acts by pharmacies and licensees related to prescription handling and drug distribution.

• Establishes specific exceptions allowing patient-specific filled prescriptions to be delivered to prescriber clinics for patients without secure mailing addresses, for drugs requiring special handling, for sterile compounded drugs, for Medicare/Medicaid ESRD patients, and for radiopharmaceuticals.

• Permits veterinary prescription drugs to be shipped directly from Oklahoma licensed wholesalers/distributors to clients when dispensed by a licensed veterinarian with an existing veterinary-client-patient relationship.

• Requires written drug diversion detection and prevention policies; establishes criminal penalties including misdemeanor for first violation (up to 1 year jail and $1,000 fine) and felony for second violation (up to 5 years imprisonment and $2,000 fine).

• Becomes effective November 1, 2016.
