Amends 22 O.S. 2011, Section 19a to allow courts to order expungement of law enforcement and court records when a charge is dismissed due to identity theft.

Permits the district attorney, defendant, or court to motion for expungement when the court finds the defendant was arrested or charged as a result of their name or identification being used without consent by another person.

Requires the expungement order to contain a statement that dismissal and expungement are ordered pursuant to this section, and all fees resulting from the charge shall be dismissed.

Subjects expungement orders to the provisions of subsections D through M of Section 19 of Title 22 of the Oklahoma Statutes.

Effective date: November 1, 2016.
