SB1509 Summary

• Authorizes public trusts and public agencies with county or municipality beneficiaries to grant in-state bid preference on construction contracts exceeding $50,000 when in-state bidders are within 5% of the lowest out-of-state bid price.

• Requires in-state bidders receiving preference to agree to perform the contract at the same price and terms as the lowest out-of-state bidder and to be qualified for the work.

• Mandates that any in-state bid preference must be adopted through an established written policy by the governing body and clearly stated in bid specifications.

• Increases emergency contract threshold for public trusts from $50,000 to $75,000 when immediate need exists to avoid loss of life, property damage, or public safety threats.

• Takes effect November 1, 2016.
