SB 1519 Summary

• Adds educational requirement option allowing accused to complete minimum 24 credits at a local community college plus life skills and student support programs as part of deferred prosecution agreements.

• Requires accused participating in educational requirements to meet all eligibility requirements for federal Pell Grant student aid.

• Makes all deferred prosecution agreements including fees, assessments, and financial terms public records on or after the effective date.

• Requires district attorney offices to provide names and identifying information of accused entering deferred prosecution agreements upon request within a reasonable time.

• Applies transparency requirements prospectively; deferred prosecution agreements entered prior to effective date remain confidential unless confidentiality was waived.

• Effective date: November 1, 2016.
