SB 1530 Summary

• Adds Item 33 to the Oklahoma Consumer Protection Act's unlawful practices list, making violations of Section 2 of this act (new Section 755.6) an unlawful practice.

• Prohibits any person or entity from requiring payment of a fee or other consideration to remove, revise, or refrain from posting arrest and booking records (including booking photographs) for individuals who had no charges filed, had charges dismissed, or had records expunged.

• Exempts interactive computer service providers, information service providers, and telecommunications service providers from liability under this section for content posted by other persons, per 47 U.S.C. § 230(f)(2) and 47 U.S.C. § 153.

• Violations of the photograph removal prohibition are enforceable as unlawful practices under Section 753 of Title 15 of the Oklahoma Statutes.

• Effective date: November 1, 2016.
