SB 1533 Summary

• Amends 12 O.S. 2011, Section 2011 regarding signature requirements for pleadings, motions, and papers in Oklahoma civil procedure.

• Modifies sanctions for violations by changing "shall not" to "may" for monetary sanctions against represented parties for legal contentions violations and for court-initiated sanctions unless an order to show cause is issued before voluntary dismissal or settlement.

• Requires mandatory monetary sanctions consisting of reasonable costs and attorney fees for violations involving improper or frivolous purpose, such as harassment, unnecessary delay, or increased litigation costs.

• Sanctions must be limited to deterring repetition of conduct and include court description and explanation of the violation and basis for sanctions imposed.

• Becomes effective November 1, 2016.
