The Long-Range Capital Planning Commission must submit its annual itemized capital project list to the Governor, President Pro Tempore of the Senate, and Speaker of the House within the first seven legislative days of a regular session, ordered by priority.

The Legislature has 45 calendar days from submission to pass a concurrent resolution disapproving proposed projects; projects are automatically approved if no disapproval action is taken by the deadline.

State agencies may request the Director of the Office of Management and Enterprise Services to substitute emergency projects (declared under Section 130 of Title 61) for existing approved projects or add new emergency projects if the agency has none on the current fiscal year's Capital Improvement Plan.

Emergency project substitution requires two conditions: the Director must determine available funds in the Maintenance of State Buildings Revolving Fund to cover the project cost, and the President Pro Tempore of the Senate and Speaker of the House must approve the substitution within five calendar days of submission.

The Director has authority to redirect funds within the Maintenance of State Buildings Revolving Fund for emergency projects approved by the President Pro Tempore and Speaker.
