Oklahoma Health Care Authority must make Medicaid payments to nursing facilities for individuals requiring daily skilled nursing services, substantial assistance with four or more activities of daily living, or 24-hour supervision due to cognitive impairment

Same eligibility standards apply to home and community-based waiver services under Section 1915(c) of the Social Security Act as an alternative to nursing facility admission

Authority must use the Minimum Data Set 3.0 Resident Assessment Instrument (MDS-RAI) to determine medical necessity, with input from a technical expert panel and stakeholders

Eligibility redeterminations required quarterly or upon significant change in recipient's condition; a qualified independent contractor must be retained by January 1, 2016 to administer requirements

Provisions apply to new applicants on or after January 1, 2016 and exclude individuals with intellectual disabilities; effective date September 1, 2015
