Senate Joint Resolution No. 68 Summary

• Directs Secretary of State to refer constitutional amendment to voters that repeals Article XXVIII and creates new Article XXVIIIA governing all alcoholic beverages in Oklahoma.

• Prohibits common ownership between manufacturing, wholesaling, and retailing tiers of alcoholic beverage business, with limited exceptions for brewers to own up to 2 beer wholesaler branches and for small brewers as defined by law.

• Requires manufacturers and winemakers to sell through Oklahoma wholesalers on same price basis without discrimination, but allows small wineries producing no more than 15,000 gallons annually to directly sell to restaurants and retail outlets.

• Establishes three off-premise retail license types: Retail Spirits Licenses (limited to sole proprietors/partnerships with 5-year state residency), Retail Wine Licenses, and Retail Beer Licenses, with restrictions on corporate ownership and felony convictions.

• Becomes effective October 1, 2018, except for provision allowing brewers to obtain low-point beer distribution licenses, which becomes effective upon voter approval.
