HB 2216 Summary

• Noncontracted providers must notify enrollees that services will be provided on a noncontracted basis and provide a good-faith estimate of charges.

• Providers must disclose whether they accept assignment of benefits for the plan's allowed amount without balance billing, or elect to balance bill the enrollee with disclosure that charges may exceed the plan's allowed amount.

• For nonemergency services, noncontracted providers must provide required information within 14 calendar days prior to rendering services; for emergency services, information must be provided as soon as practical once the enrollee is stabilized.

• Balance bill is defined as payment demanded directly from the enrollee to collect the difference between the provider's charge and the plan's allowed amount, excluding copayments, deductibles, or coinsurance.

• The act becomes effective November 1, 2017, and codifies the requirements as Section 1271 of Title 36 of the Oklahoma Statutes.
